Czech Senate to support new European media regulations, after adjustments

The Czech Senate praised the efforts of the European Commission to support the independence and freedom of the media, their plurality and their transparent financing from public money. However, in agreement with the government, it requested that the legal framework for the issuance of the European Media Freedom Act be clarified. It is concerned not to interfere with the powers of the member states of the union.

The Upper House wants to clarify the competences of the proposed European Media Services Corps and limit the range of media service providers that should be protected against possible interception or wiretapping.

The Minister of Culture Martin Baxa (ODS) described the Senate's opinion, which was prepared by his European committee, as balanced. He opposed the proposal of Senator Daniela Kovářová (independent), according to which the Czech Republic should completely reject EU regulation as an unreasonable interference with the powers of the member states.

According to the opinion, the Senate praised the European Commission's efforts to make information on media owners available and the overall increase in transparency of the ownership structure and financing of media services. However, he drew attention to the need for this obligation to also apply to micro-enterprises.

The Upper House also appreciated the effort to ensure adequate and stable financial resources for public media providers to fulfill their mission and to protect editorial independence. At the same time, the Senate is convinced of the importance of transparent support for private media.

According to European Commissioner Věra Jourová, the new EU legislation should ensure that states and their organizations do not interfere with media content. "States or their organizations must not interfere with the content of what should be in the media," Jourová said in August regarding the content of the regulation. If the media receives income from public money, it should be clearly determined what these funds are used for. "We do not want states - and this is now the practice somewhere - financed some media from public budgets, which then write well about them," said Jourová. She also wants member countries to set criteria for appointing councils of public media.

According to the European Commissioner, provisions regarding public media support will respond to the situation in Hungary. "Hungary has been an inspiration to us not only in the field of media financing from the public budget, but we are particularly reacting to the creation of a monopoly called KESMA, where today there are already several hundred different media that enjoy the largest state support, and then it is debatable to what extent such media they can be independent," said Jourová, who has previously criticized the state of the media in Hungary. The Central European Press and Media Foundation (KESMA), which controls a large part of the media, is close to the government of Hungarian Prime Minister Viktor Orbán.
